Re-urbanização compacta e eficiente precisa-se!

Gostei de ler o recente artigo de Luisa Pinto do Público sobre o estudo do Mercado Imobiliário em Portugal coordenado por Paulo Rodrigues e publicado pela Fundação Francisco Manuel dos Santos   em ABRIL 2022. 

Uma vez que a habitação é um serviço LOCAL por definição, o  desafio foi de construir um Indice de Inacessibilidade territorial ao nivel das freguesias, cruzando o preço da habitação e o nível de rendimentos das famílias. As estimativas mostram que 24% das familias de zonas rurais em declínio e até 39% das familias em zonas de urbanização crescente estão em Risco de Inacessibilidade Habitacional. 

Foram assim tipificados processos de transformação da habitação, que na minha opinião ainda não passam do diagnóstico para a solução.    Esta lista de seis processos de urbanização é útil, interessante mas incompleta, se de facto queremos  promover um parque habitacional sustentável, tanto para as famílias como para os Orçamentos do Estado e dos Municípios. 

1. Expansão urbana (crescimento das áreas urbanas de maior dimensão, originando grande concentração de população, actividades económicas e serviços).

2. Urbanização (passagem de modos de ocupação de baixa densidade para alta densidade, impelida pela migração das populações para os centros urbanos).

3. Declínio urbano (descida da população e envelhecimento demográfico, abandono de infra-estruturas e património edificado).

4. Declínio rural (abandono de áreas rurais, encerramento de serviços, despovoamento progressivo).

5. Contra-urbanização (processo de urbanização de áreas rurais que se situam para além de zonas urbanas ou periurbanas), fora dos perimetros de segurança. 

6. Suburbanização (expansão das áreas urbanas para as suas periferias), por vezes clandestina e selvagem. 

7. Re-urbanização sustentavel, reabilitação e de "re-purposing" de edifícios antigos e/ou abandonados em bairros devidamente urbanizados para criar cidades e vilas compactas e eficientes com massa-critica  sem congestionamento. 

Falta incluir a reabilitação e de re-funcionalização (o dito re-purposing") de casas e outros edificios existentes, devolutos, e mais ou menos em situação de degradação e ruína.

Em termos de investimento público, é bem mais eficiente reabilitar casas devolutas e degradadas dentro do perimetro das povoações do que construir novos bairros na periferia. Os bairros existentes já têm todas infraetruturas, água, saneamento, electricidade, telecomunicações, ruas, passeios, etc. Os bairros existentes já têm as escolas, os cafés, as igrejas, as associações, e até as tradições que apoiam a comunidade. Os mediadores do imobiliiaro bem sabem que cada casa devoluta e em ruinas desvaloriza um bairro e que cada casa recuperada e habitada pode ajudar a restaurar um bairro degradado.

O enfoque do estudo nas freguesias e municípios é certeiro e importante. Mas não basta.
Há processos e politicas nacionais que têm contribuido bastante mais para a degradação e inacessibilidade da habitação do que o aumento da procura.
  • A compra e venda de imóveis é dos processos mais burocráticos em Portugal. As licenças camarárias são uma dor de cabeça e as escrituras são uma "dor de bolso". Muitas prédios devolutos fazem parte de heranças indivisas onde os custos de compra/venda são superiores ao seu valor de mercado,. Por isso ficam abandonados, parece que para sempre, sem que os proprietários sejam responsabilizados nem apoiados.
  • Uma Câmara Municipal que se queixa que os fundos do PRR não estão disponíveis para reabilitação de edificios antigos, mas apenas para construção nova, também leva 14 meses para emitir a licença de construção de uma casa dentro do perimetro de segurança da povoação existente.
  • Um operador de serviços públicos que se queixa do custo de ter que expandir a sua rede de distribuição, também leva quase um ano a oficializar o ramal de ligação para o restauro de uma ruina num bairro do tempo do Infante D. Henrique.
Cidades, vilas e aldeias compactas, eficientes e sustentáveis ...precisam-se!

Justiça: Contratos com indícios de ilicitudes enviados à PGR - Ministra

A ministra da Justiça disse hoje numa entrevista que enviou para a Procuradoria-Geral da República os contratos de arrendamento dos tribunais feitos nos moldes das parcerias público-privadas (PPP) que «pareciam indiciar ilicitudes», estabelecidos pelo anterior governo.

Em entrevista ao Diário de Notícias, Paula Teixeira da Cruz refere que a «responsabilidade [sobre o arrendamento dos tribunais] serão apurados em sede própria», referindo também que a renegociação que fez de alguns contratos já permitiu ao ministério da Justiça poupar seis milhões de euros.
Em novembro, Paula Teixeira da Cruz, já tinha afirmado que no âmbito da reavaliação dos contratos de arrendamento dos tribunais, feitos nos moldes das parcerias público-privadas (PPP), tudo o que configurasse ilícito criminal seguiria o seu caminho rumo ao Ministério Público.

Justiça em tempo de crise

Os gestores da Ferrostaal já foram condenados na Alemanha por corrupção na venda de submarinos à Grécia e a Portugal.

Mas  a Justiça não viu nada em Portugal, segundo diz o PGR.
A Justiça em Portugal deve ser cega, surda e muda, para não dizer pior.
Será que não há ninguém na PGR que saiba ler alemão?
O Procurador-Geral da República (PGR) refutou a tese de que a economia portuguesa funciona mal por culpa dos tribunais e deste tipo de crime.

Dois anos de prisão com pena suspensa e pagamento de coimas foi a sentença do tribunal alemão no processo da venda de submarinos da Ferrostaal a Portugal e Grécia
A justiça alemã condenou hoje dois ex-executivos da Ferrostaal a dois anos de prisão, com pena suspensa, e ao pagamento de coimas por suborno de funcionários públicos estrangeiros, na venda de submarinos a Portugal e à Grécia.


O ex-administrador da Ferrostaal Johann-Friedrich Haun e o ex-procurador Hans-Peter Muehlenbeck já se tinham dado como culpados perante o Tribunal regional de Munique, a troco da garantia dada pelo juiz de que a sentença não iria além da pena que foi realmente aplicada.


Haun terá de pagar uma coima de 36 mil euros e Muehlenbeck de 18 mil euros, anunciou o juiz do processo, Joachim Eckert.


O Ministério Público de Munique acusou os dois ex-gestores da Ferrostaal de terem pago "luvas" no valor de 62 milhões de euros, entre 2000 e 2003, para conseguir vantagens sobre a concorrência e vender submersíveis a Atenas e Lisboa. Os antigos gestores, ambos de 73 anos, estiveram anteriormente cinco meses em prisão preventiva.


A Ferrostaal, arguida no mesmo processo, reconheceu as práticas ilegais e aceitou pagar uma coima de 140 milhões de euros, que só não foi maior porque o tribunal teve em conta a atual precária situação da empresa.


A queixa-crime incidia sobretudo nas atividades de Haun e Muehlenbeck na Grécia, no ano 2000, através de intermediários, para obter dois contratos de vendas de submarinos. Quanto a Portugal, o tribunal deu como provado que Haun e Muehlenbeck subornaram o ex-cônsul honorário em Munique Juergen Adolff, pagando-lhe 1,6 milhões de euros, através de um contrato de consultoria, para que o diplomata propiciasse contactos com o governo português.


No contrato, o empresário bávaro comprometeu-se a prestar "assistência orientada" no que respeita ao fornecimento de submarinos à marinha portuguesa, sustentou o Ministério Público de Munique.


A queixa-crime foi omissa quanto a eventuais reuniões que Adolff terá conseguido organizar com membros do executivo, na altura chefiado pelo atual presidente da Comissão Europeia, José Manuel Durão Barroso, e em que Paulo Portas era ministro da Defesa. Adolff, que foi exonerado pelo governo português em março de 2010, depois de a justiça alemã ter informado Lisboa, continua sob investigação em Munique e poderá ser julgado por corrupção passiva.


Os dois submarinos foram entregues à marinha portuguesa, mas em Portugal há ainda um processo jurídico, relacionado com as contrapartidas que a parte alemã se comprometeu a pagar no negócio que custou 880 milhões a Lisboa.

São Tomé e Príncipe ainda deficiente no combate à lavagem de dinheiro


O Grupo de Trabalho de Acção Financeira, a Financial Action Task Force (FATF) é o órgão que define critérios de anti-lavagem de dinheiro e combate ao financiamento do terrorismo (AML / CFT). A fim de proteger o sistema financeiro internacional no que respeita à lavagem de dinheiro (money laundering) e ao financiamento de terrorismo e incentivar uma maior conformidade com as normas AML / CFT, o FATF identifica jurisdições que têm deficiências estratégicas nesta matéria  e trabalha com elas para lidar com essas deficiências que representam um risco para o sistema financeiro internacional .

Apesar de um compromisso político de alto nível para trabalhar com o FATF-Finanacial Action Task Force para melhorar o seu plano estratégico anti-lavagem de dinheiro, São Tomé e  Príncipe não fez progressos suficientes na aplicação do seu plano de acção, e certas deficiências estratégicas permanecem.

São Tomé e Príncipe deve trabalhar na resolução destas deficiências, incluindo:  
(1) criminalizar a lavagem de dinheiro  e o financiamento do terrorismo
(2) estabelecer e financiar uma Unidade de Investigação totalmente operacional e eficaz   
(3) assegurar que as instituições financeiras e estão sujeitos a regulação adequada e supervisão sobre AML / CFT, e que as autoridades competentes tenham sido designadas para garantir a conformidade com requisitos AML / CFT
(4) implementar sanções efectivas, proporcionais e dissuasivas, a fim de lidar com pessoas singulares ou colectivas que não cumpram com a AML nacional / requisitos CFT
(5) tomar as medidas necessárias para obter a adesão do GIABA.

O GAFI encoraja São Tomé e Príncipe a solucionar as deficiências restantes e continuar o processo de implementação do seu plano de acção.

UNDP has established a partnership on electoral assistance with the European Commission and EU member states. The European Commission (EC)-UNDP Partnership on Electoral Assistance mobilized more than 450 million EURO since 2004 for financial and technical support to transitional democracies and post conflict countries in order to promote and contribute to the organization of genuine and sustainable electoral processes. For this an EC-UNDP Joint Task Force (JTF) on Electoral Assistance composed of the EC, UNDP BDP and PSO was established to further strengthen and facilitate the already existing EC-UNDP partnership in the field of electoral assistance and improve the overall efficiency and adherence of the projects to the common EC-UNDP strategic approach.

Funded up to 6.1 million Euros for a three years’ budget, the Project in Support of the 2010-2012 Electoral Cycles in the PALOP and Timor Leste has a regional scope and is financed by the EC as sole donor. The project implementation will be ensured by UNDP Guinea Bissau through direct execution modality (DEX). Building on past and ongoing support in the electoral domain to the PALOP and Timor Leste, the strategy follows a project based approach, compatible with the nature of a multi country initiative.

The project is a good example of coordination and harmonisation and is in line with the principles of the Paris and Accra Declarations on Aid Effectiveness in the sense that a) it is clearly demand-driven and is being designed as a result of extensive consultation among the relevant actors, b) it involves a strong coordination among its stakeholders and resources for the implementation of the project will be applied to finance regional harmonized activities, in line with the project’s multi country strategy, c) aims to support the capacity building of national institutions and to provide support based on partner countries’ national strategies, institutions and procedures; d) should complement and strengthen existing efforts in the different sectors and avoid duplication of efforts and rationalise activities.



Competencies

Professional:
  • Background and experience in electoral processes, especially voter registration, training of electoral officials and voter education. 
  • Demonstrated knowledge and understanding of approaches, tools and methodologies related to planning, executing and monitoring the implementation of technical assistance projects. 
Planning and Organization:
  • Excellent analytical and organizational skills required; ability to plan own work, manage conflicting priorities, report on work progress and deliver outputs in a punctual manner.
Coordination:
  • Ability to effectively interact and coordinate with donors and senior officials;
Technological awareness:
  • Fully proficient computer skills and use of relevant software and other applications, e.g. word processing, PowerPoint or equivalent, internal databases, Internet, etc.
  • Knowledge of information technology systems and applications in electoral management would be an asset. 
Communication: 
  • Strong communication (spoken and written) skills and ability to articulate ideas in a clear, concise style.

Required Skills and Experience

Education:
  • Advanced University Degree (Masters or equivalent) in Political Sciences, Law, International Relations or related field; Post graduations, Specific study and publications in governance and electoral matters are an asset.
Experience:
  • 10 years relevant work experience, at least 7 of which involve programming, formulation, management and advice on electoral assistance activities
  • Experience in planning and formulating election observation missions and/or electoral assistance projects for international organizations is an asset;
  • Experience in donor coordination, donor government relations and managing a multi-donor basket fund is an asset;
  • Experience in working with transnational and emerging democracies and post-conflict environments, particularly in the PALOP-TL, are an asset;
  • Computer proficiency, including working knowledge of MS Office products (Word, Excel, PowerPoint), Front Page, Adobe In-Design; web-based management systems.
  • Knowledge and experience in UNDP electoral assistance and electoral cycle approach – UN/UNDP guide on electoral assistance/ Joint EC-UNDP guidelines on electoral assistance.
Language Requirements:
  • Fluency in both Portuguese and English required.

3. OFFICE OF THE PROSECUTOR GENERAL (OPG) ADVISOR (PROSECUTION)
The long term OPG Corruption Advisor will provide daily technical assistance and skills transfer to the Prosecutor General, Deputy Prosecutor General and line staff on developing corruption-specific cases for prosecution. Areas of focus include: investigations analysis; evidence gathering; and prosecutorial techniques. Experience in East Timor and/or Indonesia strongly preferred. USAID experience required.

SUPERVISORY M&E SPECIALIST / CHIEF OF PARTY
Social Impact (SI) is an Arlington based international development management consulting firm. We provide a full range of innovative management consulting, technical assistance, and training services to strengthen international development programs, organizations and policies. We provide services globally in the areas of democracy and governance, health and education, agriculture, the environment, and economic growth.
Objective:
SI is seeking an experienced Senior M&E Specialist/Chief of Party to support an upcoming USAID evaluation of Timor-Leste MCC Threshold Program for Anti-Corruption. The project aims to:
•Assist the Government of Timor-Leste (RDTL) in the monitoring and evaluation of the implementation of the six program components of the Threshold Program for Anti-Corruption (TPA) aimed at improving performance in the “Control of Corruption.”
Role:
The Supervisory M&E Specialist/Chief of Party will be the key liaison with USAID/Timor-Leste, the RDTL and Implementing Partner. His/her primary responsibilities are:
•Design the program Performance Monitoring and Evaluation Plan (PMEP)
•Manage day-to-day M&E needs of the program.
•Providing overall leadership management and general technical direction of the entire program and ensure an integrated vision among different components and actors
•Identify issues and risks related to program implementation in a timely manner, and suggest appropriate program adjustments.
Qualifications:
•Must have at least ten years’ overseas experience in qualitative and quantitative M&E methodologies, developing and managing programs involving anti-corruption programming, related anticorruption/ rule of law programs, with experience in Southeast Asia/Pacific preferred.
•Experience must also include:
•Experience in the field of management, strategic planning, monitoring and evaluation, and successful past performance building relationships with governmental organizations, private and community organizations.
•Strong technical background in political and/or social governance areas.
•Experience in methodologies that address key policy efforts that resolve specific barriers to adequately implement M&E programs.
•Familiarity with statistical analysis software, including STATA and/or SPSS.
•Familiarity with gender mainstreaming and analysis.
•A master’s degree (or foreign equivalent) required in political science, international relations, economics, geography, public/business administration, other social sciences, or similar relevant area.
•Previous USAID experience preferred.

Project Drescription:
Global Objective the Review of the Project to Reform the Justice System is to report and inform Stakeholders of the extent to which the programme has produced or is on track to produce its intended development results, to understand the reasons for such performance, and to identify the key lessons which can inform the design and implementation of activities associated with the Integrated Strategic Plan (PEI) for the sector.

The overall objective of the Mozambique justice system review is to inform stakeholders of the extent to which the justice programme has produced or is on track to produce its intended development results, to understand the reasons for such performance, and to identify the key lessons which can inform the design and implementation of activities associated with the Integrated Strategic Plan (PEI) for the sector.
The team will be composed by four members namely two qualified lawyers, a capacity building expert and a sociologist. The team is expected to apply a multidisciplinary approach to the analysis and evaluation of the project components.

Governance expert (Category I)Qualified lawyer (graduate in law, preferably from a civil law country) or equivalent.
-Minimum 15 years of overseas experience in a post-conflict/development context preferably in the areas of justice or governance policy development;
-Prior experience of conducting evaluations of justice support programmes;
-Experience in the design/implementation of institutional capacity-development projects;
-Knowledge about the application of the Paris Declaration;
-Excellence in both written and conversational English;
-Ability to communicate in Portuguese would be an asset;Initiative, ability to work independently, sound judgment and good interpersonal skills;
-Experience and knowledge of the socio-political context of Mozambique would be an asset, in particular in relation to the justice sector;

Planning and Capacity building development expert (Category II)
Masters degree in a relevant field;At least 10 years experience in the design and execution of performance monitoring systems or in the design and implementation of evaluations of large and complex development programmes;
-At least 10 years experience of institutional capacity-development programmes, including experience in the area of civil society and community development;Excellence in both written and conversational English;
-Ability to communicate in Portuguese would be an asset;
-Initiative, ability to work independently, sound judgment and good interpersonal skills;Experience with financial management and accountability issues;
-Experience and knowledge of the socio-political context of Mozambique would be an asset, in particular in relation to the justice sector;~

Justice Sector Expert (Category III)
Qualified lawyer with professional experience as a lawyer in Mozambique; Minimum 5 years of working experience, preferably in Mozambique.
-Extensive knowledge and experience with regard to the institutions of the Mozambican Justice Sector, covering design and implementation of development projects/programmes related to the justice sector;
-Knowledge on the risks, problems and challenges facing the Sector;
-Understanding of the need for coordination between the various institutions involved in the process of justice administration.
-Experienced in project evaluation methodology.

Social Sciences Expert (Category III)
Degree in social sciences, political sciences or related field with excellent analytical skills. Minimum 5 years of working experience, preferably in Mozambique.
-Competence in the field of governance, security analysis, media and communication strategies, public opinion studies.
-Academic background and publications will be an advantage.
-Fluent in English and Portuguese
-Experienced in project evaluation methodology.

Chef d'équipe et Régisseur projet Justice Le Programme d´Appui aux Organes de Souveraineté et à l´État de Droit (PAOSED) est un programme de 6 M€ de 34 mois financé par la CE sur le 9ème FED dont l’objectif est de contribuer à l´amélioration de la bonne gouvernance et à la consolidation de l´Etat de Droit en Guinée Bissau, l´objectif spécifique étant de garantir un meilleur fonctionnement du pouvoir législatif, du pouvoir judiciaire, un meilleur contrôle des activités du Gouvernement et un meilleur accès à la justice de la population.
OBJECTIF GLOBAL L'objective global du marché est de contribuer à l´amélioration de la Bonne Gouvernance et à la consolidation de l´Etat de Droit en Guinée Bissau.
OBJECTIVE SPECIFIQUES Les objectifs spécifiques du marché sont les suivants:
- Assurer la gestion du programme suivant les modalités de régie indirecte du 9ème FED, en assumant toutes les responsabilités administratives et financières en découlant;
- Garantir un meilleur fonctionnement du pouvoir législatif, du pouvoir judiciaire et un meilleur contrôle des activités du gouvernement et un meilleur accès la justice.
Profil demandé:
• Formation supérieure (minimum maîtrise en Droit – Universitaire, Juriste, Avocat).
• Spécialisation en administration publique et systèmes judiciaires.
• Parfaite maîtrise du portugais parlé et écrit et bonne connaissance du français.
• Expérience professionnelle de dix ans au niveau de la coordination de projets comprenant des composantes de la justice et de développement.
• Expérience professionnelle d´au moins de cinq ans en pays en voie de développement.
• Expérience de travail sur des projets sous financements internationaux, et particulièrement du FED.
