L'objectif spécifique de cette mission est d'évaluer la pertinence, l'efficience, l'efficacité, l'impact et la viabilité du Programme Intègre du Renforcement des Systèmes Juridique et Judiciaire (PIRSJJ) au Bènin. Trois experts maîtrisant parfaitement le français sont nécessaires à l’exécution de la mission :
1. Un expert juriste, de formation supérieure, ayant au minimum dix ans d'expérience générale, et justifiant d'une connaissance approfondie du système judiciaire des pays dont la culture et le système judiciaire sont similaires à ceux de la République du Bénin. L'expert doit avoir exécuté au moins deux missions similaires dans les pays en voie de développement.
2. Un expert en gestion des projets avec une solide expérience en suivi-évaluation, de formation supérieure, ayant au minimum dix ans d’expérience générale, ayant à son actif au moins cinq évaluations de projets de même envergure dans les pays en voie de développement. La connaissance du secteur de la justice est un atout.
3. Un expert en statistique-économie, ayant au minimum un diplôme de 2ème cycle en statistique, ayant au moins 5 ans d’expérience pertinente en matière de suivi-évaluation et conception/formulation d’indicateurs. La connaissance du secteur de la justice est un atout. Le bureau d’étude désignera un chef de mission parmi les trois experts.

Slovak PPP Association created

The Role of the Slovak PPP Association 31 March 2008
About forty private companies joined forces last year and established the Slovak PPP Association in order to support public-private partnership projects in Slovakia. The members are financial, consulting, construction, technological or law companies, many of which have international PPP know-how. The Association aims to participate in the creation of favourable conditions for the development and implementation of PPP projects in Slovakia, stir discussion on the various forms and potential areas of PPP schemes application and act as a partner for the public sector in all matters regarding PPP.
Despite being a late-comer with respect to public-private partnerships (PPPs) compared to neighbouring countries such as the Czech Republic or Hungary, two major PPP infrastructure projects – the D1 Motorway and the R1 Expressway - are currently under tenders in Slovakia and more PPP projects seem likely to emerge in the near future in various areas, such as sports, culture, waste treatment or healthcare. The Ministry of Education is currently considering a major PPP project – a multifunctional ice-hockey stadium, which should be built in Bratislava latest by the end of 2010. Smaller PPP projects are under discussion in a number of Slovak regions and cities.
The Slovak government officially declared support for PPP projects in its Program Declaration in 2006 and created a PPP Department at the Ministry of Finance, which is providing the public sector with advice as well as partial funding of the preparatory and advisory costs from the EU Structural Funds.
Because of the relatively little experience with PPPs in Slovakia, the success of the first pilot PPP projects will be crucial in increasing trust and popularity of PPPs. The Slovak PPP Association intends to contribute to the creation of such conditions for PPPs in Slovakia, which will enable both value-for-money as well as high quality services for citizens.

Critical mass for mass transit

According to an article in the Economist (29-March-2008), Los Angeles is discovering the importance of "transport-oriented development" and is looking for "elegant density" along express bus routes and subway stops.

Elegant density may be an Hollywood concept difficult to translate into economics, but the synergies between urban transport and urban land use planning are easier to understand. Most urban "mass transit" schemes are viable for heavy traffic corridors with relatively high residential population density.

The same is true for other infrastructure networks, like water or electricity. A low density network has a higher cost per user than a high density network. That's why low density rural or far suburban networks with few users often require taxpayer subsidies.

In general, it is important to minimize the dimension of the infrastructure, and the investment cost, while serving the maximum number of users. With lower investment and more users and user fees, the more viable and self-sustaining the public service project.

There is in fact a minimum "critical mass" needed to justify most "mass transit" and transport infrastructure.

GRM International is the Managing Contractor for the Australian Government assistance provided to East Timor (Timor-Leste) via the Public Sector Capacity Development Program (PSCDP). The goal of the East Timor (Timor-Leste) Public Sector Capacity Development Program is: A sustainable and effective system of governance and public administration for the delivery of high quality public services. TRÁFEGO, TRÁFEGO, TRÁFEGO

Quando eu era jovem analista de crédito num grande banco americano, aprendi os três CCC da boa concessão de crédito: carácter, carácter, carácter. Esta sigla dos CCC resumia a sabedoria e experiência dos colegas mais velhos que nos davam formação. Isto é, se o devedor for desonesto e não quiser pagar o empréstimo, de pouco vale o resto da análise de crédito. Esta regra, obviamente simplista, tem o defeito do exagero, mas tem a virtude de focar as atenções do analista sobre as questões essenciais na decisão de emprestar ou não.
À semelhança dos CCC do crédito, podia aplicar-se uma regra simples dos TTT no financiamento dos projectos de transportes: tráfego, tráfego, tráfego. A principal determinante de se um projecto de transporte pode e deve ser financiado, é o volume de tráfego existente e previsto, incluindo uma estimativa do tráfego induzido que é gerado pela própria existência da infra-estrutura. Isto significa que merecem ser financiados sobretudo os projectos que apresentam uma maior previsão de tráfego feita em moldes realistas e conservadores, a fim de evitar elefantes brancos sobredimensionados ou congestionamento no primeiro ano de serviço quando a estrada ou o terminal foi sub dimensionado.

Esta regra dos TTT deve inclusivamente aplicar-se aos projectos financeiros pelo sector privado em regime de Project Finance. Nestes casos, o financiamento tem que ser reembolsado, a partir das próprias receitas de tráfego, nomeadamente nos portos, aeroportos, comboios, eléctricos, parques de estacionamento e estradas com portagem.
Nenhum operador e investidor privado pode dar-se ao luxo de investir num projecto que depende de um volume de tráfego médio diário de 10.000 se as previsões mais optimistas indicam apenas 5.000 utentes a longo prazo, pois teria que esperar muito mais tempo para recuperar o seu investimento.

Na prática é muito difícil acertar nas previsões de tráfego. As infra-estruturas de um aeroporto implicam investimento de muito grande escala e um longo calendário de execução, a decisão de avançar ou não com um novo projecto torna-se ainda mais difícil e arriscada. Adicionalmente, ao contrário de uma estrada, um aeroporto tem custos fixos muito elevados, tornando-se deficitário a baixos níveis de ocupação. Por isso é importante focar nos factores essenciais como as previsões de tráfego, os requisitos técnicos e o tempo de construção.
Apreciando as recentes discussões a respeito do aeroporto da OTA à luz da regra dos TTT, pode concluir-se:
- O tráfego aéreo de Lisboa não é nem se prevê que venha a ser suficiente para sustentar dois aeroportos.- Manter dois grandes aeroportos a funcionar a baixos níveis de ocupação destrói muitas das potenciais sinergias quer para os passageiros quer para as linhas aéreas.
Dispersar actividades por dois aeroportos teria consequências financeiras negativas não só para a ANA mas também para a TAP.
- Existem casos em que se manteve o antigo aeroporto apesar dos baixos níveis de tráfego, por exemplo “o problema Malpensa” Itália, mas estes são considerados casos de triste memória pelos investidores do sector.
- O tráfego aéreo de Lisboa é sobretudo um tráfego de passageiros, pois o tráfego de mercadorias em Portugal passa principalmente pelo transporte rodoviário, por exemplo no caso das importações de Espanha que é o nosso principal fornecedor, pelo que não tem relevância a referência às ligações ao porto de Sines.
- A manutenção de um aeroporto dentro de um grande centro urbano tem evidentes benefícios em termos de tráfego, mas exige uma política de segurança e de desenvolvimento a muito longo prazo com reserva de terrenos para expansão, o que não tem sido feito em Lisboa. Não basta querer manter e expandir o aeroporto na Portela, é necessário limitar a construção e desenvolvimento em áreas adjacentes, incluindo a Alta de Lisboa, o que não tem sido feito.
Convinha orientar a discussão do novo aeroporto de Lisboa em função dos TTT, tráfego previsto, tráfego mínimo e composição de tráfego, evitando que se perdesse de vista o essencial no serviço público de transportes e no seu financiamento.

Os PPPs rodoviários em crescimento nos E.U.A.

No passado dia 5 de Fevereiro, o Ministro dos Transportes dos E.U.A., Sra. Mary E. Peters, pronunciou-se a favor de novos sistemas de portagem, como modo apropriado para financiar o aumento da capacidade rodoviária e diminuir a sobrelotação das estradas. Esta iniciativa reflecte as mudanças no sector rodoviário dos E.U.A..

Os E.U.A. já tinham estradas interestaduais e com portagem, mas depois da segunda guerra mundial e inspirados na Europa, a construção de novas estradas foi muito aumentada. Após um grande impulso governamental em 1956, os E.U.A. construíram nos anos seguintes uma extensa rede de auto-estradas, o “Interstate System”. Este sistema foi financiado pelo orçamento federal e dos estados, e era gratuito para os utilizadores.

A partir da década de 1980, a infra-estrutura rodoviária dos E.U.A. começou a dar sinais de desgaste acentuado e do abrandamento da manutenção e da construção de novas rodovias. Em parte é resultado da escassez de recursos financeiros, a nível federal e estadual. Esta situação é agora agravada por previsões da necessidade de investir 118,9 mil milhões de USD até 2022, para além do nível dos orçamentos actuais. Como solução, muitos governantes querem introduzir portagens pagas em rodovias existentes, e PPPs em novas concessões de longo prazo, com novos sistemas de cobrança electrónica que abrandam menos o fluxo de tráfico, um inconveniente criticado nas portagens antigas.

As grandes empresas de construção privadas já demonstraram interesse em participar nos projectos rodoviários de reabilitação ou construção, e em investir capitais, em parceria com o sector público ou separadamente. Alguns PPPs rodoviários mais recentes envolvem empresas externas aos E.U.A.. Em 2006, no estado de Indiana, os grupos espanhol Cintra e australiano Macquarie pagaram 3,8 mil milhões de USD por uma concessão rodoviária de 157 milhas, por 75 anos, com receitas esperadas de 11 mil milhões de USD. Outro operador Australiano, a Transurban, pagou mais de 500 milhões de USD pela concessão de 99 anos na Pocahontas Parkway da Virginia, e o estado do Texas autorizou a proposta de 1,3 mil milhões de USD da Cintra e da Zachry Construction para uma PPP de 40 milhas em Austin, no Texas. A Brisa e a CCR Brasileira assinarem uma concessão de 99 anos no Colorado, a NW Parkway, um troço de 11 milhas da estrada circular de Denver.

Estes são alguns dos projectos actuais. Outros estão em estudo nos estados de Nova York, Ohio, Pensilvânia, New Jersey, Alabama, Alasca, Delaware, Califórnia e Wisconsin. Mais de 20 estados aprovaram legislação sobre PPPs. As estimativas actuais indicam que nos E.U.A. há PPPs rodoviários em preparação por mais de 25 mil milhões de USD.

A estatística actual do total das estradas com portagem nos E.U.A., públicas e privadas, mostra que se em 1997 havia 2.771,60 milhas no sistema Interstate e 1.599,30 milhas não Non-Interstate, em 2007 estes totais são de 2.908,46 milhas e 1.939,07 milhas, respectivamente.

A titulo indicativo, muitos dos troços rodoviários actuais com mais de 25 milhas, com portagem mas que não pertencem ao “Interstate System”, pelo que provavelmente mais acessíveis á iniciativa privada, estão nos estados da California, Florida, New Jersey, Oklahoma e Texas.

União Europe emite orientações sobre PPP

A Comissão Europeia emitiu orientações sobre PPP Institucionais, "parcerias institucionais" criadas como empresas de capital misto (joint partnerships) para a prestação de serviços públicos.

As orientações visam reduzir as dúvidas e aumentar a transparência.
Segundo as novas orientações , um único processo concursal é necessário para escolher o parceiro privado para a nova entidade mista e para a adjudicação do contrato de prestação de serviços públicos. No entanto, se houver lugar a projectos ou serviços adicionais, esse subcontrato não pode ser adjudicado ao parceiro privado sem concurso, ficando sujeito às regras da contratação pública. Isto evita o concurso duplo, um para seleccionar o parceiro privado e outro para atribuir o contrato ou concessão, que seria pouco prático.

Estas orientações vêm no seguimento do Livro Verde sobre PPP (PPP Green Paper -IP/04/593) eIP/05/1440 , e a resolução do European Parliament (see Resolution on PPP of 26 October 2006)

Assignment: Preparation of an impact assessment, which has been foreseen in the Technical and Administrative Provisions (TAP) of the project’s Financing Agreement, will provide the decision-makers in the Government of Guinea-Bissau, the relevant external co-operation services of the European Commission and the wider public with sufficient information to:
(a) make an overall independent assessment of the past performance of EC-budget support in Guinea Bissau (ABS I and II), paying particularly attention to the impact of the project actions against its objectives;
(b) identify key lessons and to propose practical recommendations for follow-up actions, including the preparation of a new general budget support programme (ABS IV) under the 10th EDF/NIP.
The team will be composed of 2 experts with the following profiles and qualifications:
Expert 1 • senior expert, category I or II, team leader, economist/project planner or analyst, university education, extensive and relevant experience (minimum 10 years); • a solid and diversified experience in the specific field of macroeconomics, including experience in budget support and development issues; • a solid and diversified experience in the evaluation of projects; • Sound knowledge of Portuguese and excellent report writing in French or English; • fully conversant with the principles and working methods of project cycle management and EC aid delivery methods.;
Expert 2 • category III, university education and relevant experience (minimum 5 years); • experience in the field of public finances management; • full working knowledge of Portuguese and/or French, and excellent report writing;
The composition of the team of experts should be balanced to enable complete coverage of the different aspects of project evaluation, as set out in these terms of reference, and programme formulation. The team as a whole should possess a sound level of knowledge and experience in the West African region or African Portuguese speaking countries.

L'objectif de la mission est de fournir aux services de la Délégation les éléments d'information et d'analyse leur permettant d'apprécier le fonctionnement du FOMAN–Cofinancement et, de manière plus générale, de l'ensemble d'outils mis en place par les pouvoirs publics au profit des entreprises marocaines et facilitant leur accès au financement. PROFIL DE L’EXPERT Pour mener à bien la mission, les services d’un expert international de catégorie I sont requis.
